  • A. At the conclusion of the hearing, or as soon afterward as may be practical, the presiding board member shall issue a Decision and Order, including findings of fact and conclusions of law, which shall be served upon the parties or their counsel, if represented. The presiding board member may also require the parties to submit proposed findings of fact and conclusions of law.

    B. The Decision and Order is the final administrative decision of the Fund. Any refusal to accept applications and any termination of the producer's right to bind coverage with the Fund, which had been implemented before the hearing, shall remain in effect until the Decision and Order is issued.

    C. If the decision is in favor of the producer, the presiding board member shall immediately reinstate the producer's right to submit applications and to bind insurance with the Fund.

    D. If the decision is adverse to the producer, the presiding board member may affirm the Fund's decision to refuse to accept further applications from the producer and to terminate the producer's right to bind coverage with the Fund, or both.
