Sec. 08.02.01.05. Targets for the Number of Tidal Fish License Authorizations

A. The targets for the number of tidal fish license authorizations issued by the Department are the number of authorizations issued between September 1, 1998, and March 31, 1999, including adjustments made annually according to specifications listed in §B of this regulation, listed by the following categories:

The targets for the number of tidal fish licenses may be modified based on:
(1) Recommendations of the Tidal Fisheries Advisory Commission;
(2) Recommendations of fishery management plans adopted by:
(a) The Department;
(b) The Chesapeake Bay Program;
(c) The Atlantic States Marine Fisheries Commission;
(d) The Mid-Atlantic Fisheries Management Council; or
(e) Any other appropriate management body;
(3) The number of individuals historically participating;
(4) Target species, size, number, weight, incidental catch, total biomass, annual harvest, mortality rates, and other factors which are necessary and appropriate;
(5) The number of license conversions made in accordance with Natural Resources Article, §4-701(m), Annotated Code of Maryland; and
(6) The number of authorizations purchased back from license holders by the Department.
C. Except for authorizations relinquished for conversions made in accordance with Natural Resources Article, §4-701, Annotated Code of Maryland, authorizations that are revoked or voluntarily relinquished to the Department may be reallocated to individuals on the commercial license waiting list maintained by the Department.
