Sec. 34.04.06.13. Extensions of Time for Study

  • A. Studies by Authorized Institutions or Organizations.

    (1) The Trust may approve an extension of time for study beyond the 1-year study period provided in Regulation .11 of this chapter if a researcher submits a written application to the Trust.

    (2) An application for an extension shall include a:

    (a) Summary report of work to date, including preliminary results and tasks accomplished in relation to the overall study work plan;

    (b) Description of the necessity for the request; and

    (c) Revised plan and timetable for study completion.

    (3) An extension may not exceed 1 year.

    (4) A researcher may apply for additional time extensions as necessary.

    (5) The Trust may grant an extension if:

    (a) It finds, based on the information submitted with the application, that the researcher has made a good faith effort to complete the study within the original 1-year time frame and any extensions;

    (b) For remains and objects for which a lineal descendant has been identified, the lineal descendant approves the time extension; and

    (c) For culturally affiliated Native American remains and objects for which no lineal descendant has been identified, culturally affiliated Native American tribes approve the time extension.

    B. Studies by the Trust. For studies performed by the Trust under Regulation .12 of this chapter, the Secretary may grant a time extension if the Trust submits a written request containing the information in §A(2) of this regulation, and the Secretary finds that the Trust has made a good faith effort to complete the study within the original 1-year time frame and any extensions. An extension may not exceed 1 year. The Trust may apply for additional time extensions as necessary.
