Sec. 29.04.02.01. Administrative Procedures

A. Each application for a special police commission which is submitted to the Secretary shall be accompanied by a check or money order in the amount of $100 payable to Department of State Police. The fee is nonrefundable if the application is denied. A fee will not be charged to any agency of the State.
B. Immediately upon receipt, all fees will be recorded in the appropriate financial ledger and deposited in an authorized banking institution for forwarding to the State Treasurer. The Finance Section will review each deposit transaction, and return a standard receipt to the depositor.
C. The results of the investigations conducted in connection with each application shall be transmitted to the Governor with a recommendation as to the denial or granting of the application. Recommendations for denial will be supported by all available documentary evidence in order to properly justify the denial.
D. The Secretary will establish such regulations as to the conduct of special police as he deems necessary and as the need is indicated.
E. In order to facilitate the orderly ingress and egress of traffic to and from the property in interest, the Secretary may approve traffic control details performed by special police officers. Those companies in interest having established traffic control programs in effect as of July 1, 1969, may continue these functions until reviewed and approved by the Secretary.
F. Each special police officer shall wear a uniform which shall be distinguishable from ordinary civilian clothing and shall give notice of his designation as a law enforcement official. When on detective duty, he shall carry identification properly identifying him as a special policeman.
G. Upon notification from the office of the Secretary of State that the applicant has received his oath of office and special police commission is then in effect, an approved and prenumbered identification card will be mailed to the employer for delivery to the applicant. The files will then be adjusted to indicate that the applicant is now a special police officer with a valid commission.
