Chapter 26.10.12. Underground Storage Tank Upgrade and Replacement Fund Loan Program |
Sec. 26.10.12.04. Eligible Applicants

Applicants shall meet the following requirements in order to be eligible for a loan:
A. If applicable, be in good standing and qualified to do business in Maryland;
B. Have the legal capacity and all necessary legal authorization to incur the obligations of the loan;
C. Demonstrate creditworthiness, repayment capability, and collateral or other security acceptable to the Department;
D. Be the owner of one or more underground storage tanks for which a loan is requested that:
(1) Was registered with the Department as provided in Environment Article, §4-411.1, Annotated Code of Maryland, on or before July 1, 1991, unless the Secretary determines that special circumstances exist, and
(2) Is required to have financial assurance under Subtitle I of the Resource Conservation and Recovery Act, 40 CFR §§280.90-280.111;
E. Be in substantial compliance with all State and federal laws and regulations governing the installation, operation, and use of underground storage tanks;
F. Have submitted a final application or loan processing form to the Department on or before June 30, 1998; and
G. Not be the State, a county, a municipal government, a local education agency, or a paid or volunteer fire company or rescue squad.
