Chapter 22.01.11. Employment of a Retiree by a Participating Employer |
Sec. 22.01.11.07. Effect of Retirement for More Than 10 Years

A. This regulation applies to a retiree who is receiving a retirement allowance from the:
(1) Correctional Officers' Retirement System;
(2) Employees' Retirement System;
(3) Teachers' Retirement System; or
(3) Employees' and Teachers' Pension System.
B. Except as provided in §C of this regulation, if a retiree has been retired for a 10-year period that begins on January 1 of the year following the year in which the retiree accepted a service retirement allowance, a retiree may accept employment with a participating employer on a permanent, temporary, or contractual basis without any reduction in retirement allowance.
C. For a retiree whose service retirement allowance is effective January 1, the 10-year period shall begin on January 1 of the year in which the retiree accepted the service retirement allowance.
