Sec. 22.01.11.01. Scope

A. Except as provided in §B of this regulation, this chapter applies to an individual who is:

(1) Receiving an allowance within the meaning of Regulation .02 of this chapter and employed by a participating employer on a permanent, temporary, or contractual basis; or

(2) Receiving an early service retirement or early vested allowance and becomes reemployed in the first 12 months of retirement.

B. Except as provided in Regulation .06 of this chapter, this chapter does not apply to a retiree who is not subject to the earnings limitation set forth in State Personnel and Pensions Article, §22-406, 23-407, 25-403, or 28-402, Annotated Code of Maryland, including a retiree who is receiving a:

(1) Service retirement allowance from the Judges' Retirement System, the Legislative Pension Plan, the Law Enforcement Officers' Pension System, or the State Police Retirement System;

(2) Special early retirement allowance under State Personnel and Pensions Article, §22-404 or 23-404, Annotated Code of Maryland, and is appointed or elected to an office for which the State pays compensation; or

(3) Service retirement allowance from a State system and is serving in an elected position as an official of a participating governmental unit or as a constitutional officer for a county that is a participating governmental unit.
