Sec. 10.25.11.12. Contract Provisions and Penalties

As a prerequisite for release of any information under this chapter, the applicant shall enter into an agreement with the Commission which:

A. Defines the scope of the use to be made of the released information;

B. Provides for safeguards for protecting the identity of data;

C. States that a breach of any condition of the agreement is a breach of contract;

D. Provides for the return or destruction of data upon a determination of breach of contract by the Commission; and

E. Authorizes the Commission to seek all other appropriate remedies for breach of contract.
