Sec. 10.24.02.02. Collection and Reporting of Hospital Data

  • A. Hospitals shall submit accurate, timely, and complete data which the Commission deems necessary for development of methodologies, planning, analysis, and Certificate of Need reviews as requested on a periodic basis.

    B. The information requested by and to be reported to the Commission may include, but is not limited to, the following types of information:

    (1) Aggregate facility data:

    (a) Types of services offered;

    (b) Licensed and operating hospital beds;

    (c) Utilization data; and

    (d) Staffing;

    (2) Patient-specific data:

    (a) Admission, discharge, and disposition data;

    (b) Demographic characteristics;

    (c) Patient residence data;

    (d) Medical diagnosis and treatment data;

    (e) Surgical and diagnostic procedure data;

    (f) Attending and operating physicians; and

    (g) Revenue data, including actual or expected source of payment; and

    (3) Data that are needed by the Commission to perform the duties described in Health-General Article, Title 19, Subtitle 1, Annotated Code of Maryland, and that are not set forth in COMAR 10.37.04, 10.37.06 or 10.37.07.

    C. Except as provided in §B(3) of this regulation, the Commission shall deem a hospital which reports data to the HSCRC to be in compliance with these regulations if it submits the information required by COMAR 10.37.04, 10.37.06 or 10.37.07 in full and within the time period set forth in those chapters.

    D. The Commission shall deem a State psychiatric hospital to be in compliance with these regulations if it submits the information required by COMAR 10.37.06 for private psychiatric hospitals under the jurisdiction of HSCRC.

    E. A hospital which does not come within the jurisdiction of HSCRC, is not required to report full patient specific data to HSCRC, as set forth in COMAR 10.37.04, 10.37.06, or 10.37.07, or is required to report data as provided in §B(3) of this regulation, shall submit to the Commission a complete response to its data request within 60 days of the last day of the time period covered by the request, or within 60 days of receipt by the hospital of a data request from the Commission, whichever is longer.

    F. The Commission shall specify the form and format of any hospital data submission requested under §§D and E of this regulation.

    G. Exemptions.

    (1) A hospital reporting under §§D and E of this regulation may request an exemption from the Commission's data request.

    (2) A request for an exemption shall be submitted in writing to the Executive Director of the Commission not later than 30 days before a submission is due, identifying the specific data element or elements for which an exemption is requested and explaining the reasons for the exemption request.

    (3) The Executive Director shall send a response to the request for an exemption to the hospital within 10 days of receipt by the Commission.
