Chapter 10.15.05. Manufacture and Sale of Frozen Dairy Foods and Ices Manufactured for Sale in Maryland |
Sec. 10.15.05.24. Labeling

A. All labeling shall comply with the regulations promulgated under the Fair Packaging and Labeling Act and the Federal Food, Drug and Cosmetic Act, as contained in the Code of Federal Regulations, Title 21 Food and Drugs, and in addition shall contain:
(1) The name of the product, and shall conform with product standards of identity as provided in Regulations .01-1-.20 of this chapter.
(2) A statement of net contents or net volume.
(3) One of the following:
(a) The name of the manufacturer and the address of his plant;
(b) The Federal Information Processing System (FIPS) Number assigned by State agency followed by the general office address; or
(c) In case of private labels, the Federal Information Processing System (FIPS) Number and the name and address of the distributor, preceded or followed by "Distributed by" or "Distributor".
(4) The "date of pasteurization" in case of frozen dessert mixes.
B. When frozen desserts are dispensed from factory-filled containers, each container shall bear an identity as described above so that it can be read after the lid or cover has been removed and discarded.
C. Required labeling information shall be in letters of an acceptable size, kind, and color satisfactory to the Secretary and may not bear or accompany any false or misleading written, printed, or graphic matter.
