Sec. 10.15.05.15. Non-fruit Sherbet

  • A. Description. Non-fruit sherbet is a food prepared from the same ingredients and in the same manner, including the requirements for labeling, prescribed in the Code of Federal Regulations, Title 21 Food and Drugs, Part 135.140 Sherbet, except that the food may not contain any fruit or fruit juice.

    B. Nomenclature. The name of the food is "Non-fruit ___ Sherbet". The blank is to be filled in by the characterizing flavor used.

    C. Labeling.

    (1) The label shall contain the following statement: "Imitation ___ Sherbet", the blank to be filled in by the characterizing flavor used. The letters in the word "imitation" shall be the same size, type, and color and on the same contrasting background as the name of the characterizing flavor and the word, sherbet.

    (2) The statement in §C(1), of this regulation, shall be followed immediately by the words, "contains no fruit or fruit juice" in letters at least half the size of the words used in the statement.

    (3) When a sign is used at the point of purchase to advertise the product, it shall contain the same information prescribed in §C(1) and (2), of this regulation.
