  • A. Revocation or Suspension.

    (1) Emergency Action.

    (a) The chief boiler inspector or an authorized representative may order an inspection certificate suspended summarily if, in his opinion, public safety imperatively requires emergency action.

    (b) If an inspection certificate is summarily suspended, the chief boiler inspector shall promptly give the owner of the boiler or pressure vessel for which the inspection certificate was issued:

    (i) Written notice of the suspension, including the reason and facts that warrant the suspension; and

    (ii) An opportunity to be heard.

    (2) General.

    (a) The chief boiler inspector shall suspend an inspection certificate if:

    (i) An inspector determines that the condition of the boiler or pressure vessel makes continued operation unsafe;

    (ii) A special inspector notifies the chief boiler inspector that an owner refuses to make promptly the repairs necessary to bring an unsafe boiler or pressure vessel into compliance with these regulations;

    (iii) The owner refuses to permit inspection of a boiler or pressure vessel; or

    (iv) The owner refuses to pay a fee required by the Boiler and Pressure Vessel Safety Act.

    (b) The chief boiler inspector or an authorized representative may suspend or revoke an inspection certificate if the boiler or pressure vessel for which it was issued:

    (i) Cannot be operated consistent with public safety; or

    (ii) Does not comply with applicable law or regulations.

    (c) Except as otherwise provided by this regulation, before suspending or revoking an inspection certificate, the chief boiler inspector shall give the owner of the boiler or pressure vessel:

    (i) Written notice of the suspension or revocation which states the reasons and facts warranting the suspension or revocation; and

    (ii) An opportunity to be heard.

    B. An inspection certificate becomes invalid:

    (1) On its expiration date; or

    (2) When the boiler or pressure vessel for which it was issued ceases to be:

    (a) Insured by an authorized insurer; or

    (b) Owned by an owner-user inspection service.
