Sec. 09.12.01.08. Hazardous Condition

  • A. A special inspector who finds a hazardous condition affecting the safety of a boiler or pressure vessel shall notify the chief boiler inspector in accordance with Regulation .28 of this chapter.

    B. If a special inspector determines that a boiler or pressure vessel is unsafe for operation:

    (1) The inspector shall:

    (a) Notify the owner promptly;

    (b) Specify the repair or corrective measure required to achieve compliance with regulations; and

    (c) If the owner does not agree to take the required action promptly, notify the chief boiler inspector immediately;

    (2) Until the required repair or corrective measure is completed:

    (a) Use of the boiler or pressure vessel is prohibited; and

    (b) The chief boiler inspector shall suspend the inspection certificate, if any.

    C. If, upon inspection, the chief boiler inspector or a deputy boiler inspector declares a boiler or pressure vessel unsafe:

    (1) The boiler or pressure vessel shall be condemned and stamped in accordance with Regulation .30 of this chapter; and

    (2) Use or operation of the condemned boiler or pressure vessel shall subject the owner to the penalties provided by Public Safety Article, §12-915, Annotated Code of Maryland.
