Sec. 09.10.06.49. Reasonable Diligence Required

A. If the Commission determines that an association is failing to exercise reasonable diligence in preparing a new racetrack to begin racing on the date approved by the Commission, the Commission may revoke its approval of the applicant and reopen the application process.
B. If the Commission takes action against an association under §A of this regulation, that association may not participate in the application process that is reopened.
