Sec. 09.10.06.17. Lease of Racetrack by Applicant

A. If an applicant for a license to operate a new racetrack intends to lease the racetrack facility from another person, the application documents shall include the information required by Regulation .10 of this chapter as it pertains to the lessor.

B. The application documents shall include a copy of the lease agreement and every other agreement or contract between the lessor and lessee.

C. The Commission may not grant a license to a person applying under this chapter if the Commission determines that the:

(1) Lessor would not be qualified to be issued a license; or

(2) Lease is a subterfuge to avoid compliance with one or more provisions of this chapter.
