  • A. Purse money earned on thoroughbred races under the provisions of Business Regulation Article, Title 11, Annotated Code of Maryland, shall be credited to the thoroughbred purse account.

    B. Purse money earned on nonthoroughbred races under the provisions of Business Regulation Article, Title 11, shall be credited to each nonthoroughbred breed purse account.

    C. If the total amount paid for purses to nonthoroughbred horses in any race meeting does not equal the amount earned as described in § B of this regulation, any over or underpayment for each nonthoroughbred breed shall be carried forward to the next race meeting of the same association, unless the association agrees to allow the over or underpayment to be transferred to the next association to race and the next association to race agrees to accept the transfer.

    D. If there is no racing for a nonthoroughbred breed that raced at the previous meeting of the association, at the next race meeting of the same association the association shall resolve the disposition of any over or underpayment with the representative of the nonthoroughbred breed as recognized by the association. The thoroughbred purse account may not be charged with any overpayment to nonthoroughbreds, and if there is no distribution of any underpayment to nonthoroughbreds, the underpayment shall revert to the thoroughbred purse account.
