  • A. The Department shall issue a public notice of an opportunity to submit written comments or to request a public hearing after the Department has determined that applications for the following are complete:

    (1) Forest conservation plan; or

    (2) Submittal of a minor development project application.

    B. The public notice shall contain:

    (1) The name and address of the applicant;

    (2) A description of the nature and location of the proposed activity;

    (3) Instructions for submission of written comments, requests for a public hearing, and requests to be included on the interested persons list;

    (4) The expiration date for the opportunity to comment or to request a public information hearing;

    (5) A statement that any further notices concerning actions on the application shall be provided only by mail to those persons on the interested persons list; and

    (6) The name, address, and telephone number of an individual in the Department from whom information about the application may be obtained.

    C. The public notice may be given by:

    (1) Joint notice with other federal, State, county, or municipal agencies;

    (2) Joint notice with other units or programs within the Department;

    (3) Selected mailing to federal, State, county, or municipal authorities and persons on the interested persons list;

    (4) Publication in a daily newspaper distributed in one or more counties which the Department determines may be directly affected by the proposed activity, or if there is no local daily newspaper, in a newspaper of general circulation in that county; or

    (5) Publication in the Maryland Register under State Government Article, §7-214, Annotated Code of Maryland.
