Sec. 08.07.01.03. Hunting and Trapping

  • A. Unless otherwise posted, hunting and trapping:

    (1) Are permitted during the regular open hunting and trapping season; and

    (2) Shall be conducted in conformity with State law.

    B. The Director may regulate specific areas, seasons, methods of harvest, and species hunted in accordance with State and federal law.

    C. Except by written permit, an individual may not trap or attempt to trap on lands owned or controlled by the Department. The permit shall be issued by the Director.

    D. Baiting Prohibited.

    (1) Except by written permit issued by the Service, on any State-owned or State-controlled properties open to public hunting, an individual may not place or cause to be placed or scatter or distribute:

    (a) Shucked or unshucked corn, wheat, or other grain;

    (b) Salt; or

    (c) Other feed.

    (2) An individual may not hunt, shoot, or kill, or attempt to hunt, shoot, or kill, game birds or mammals by the aid of bait, on or over a baited area.

    E. Permanent Blinds and Tree Stands.

    (1) The blinds or tree stands that an individual is permitted to erect on land owned or controlled by the Service are those brought in and taken with the individual each day. This does not prevent hunting at natural stands of vegetation present and uncut at the hunting site.

    (2) Except by written permission from the Service, an individual may not use or construct permanent blinds or tree stands on lands owned or controlled by the Service.

    (3) Reed grass (Phragmites australis) may not be used for the construction of blinds on lands owned or controlled by the Service.
